Personal Data Protection Terms

I. Basic Provisions

The controller of personal data pursuant to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”) is Ketom Impex s.r.o., Company ID No.: 17801826 (hereinafter the “Controller”).

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
The Controller has not appointed a Data Protection Officer.


II. Sources and Categories of Processed Personal Data

The Controller processes personal data that you have provided to the Controller, or personal data obtained by the Controller in connection with the performance of your order.
The Controller processes your identification and contact details and data necessary for performance of the contract.


III. Legal Basis and Purpose of Personal Data Processing

The legal basis for processing personal data is:
performance of the contract between you and the Controller pursuant to Article 6(1)(b) GDPR,
the Controller’s legitimate interest in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR,
your consent to processing for the purposes of direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, where no order for goods or services has been made.
The purpose of processing personal data is:
to process your order and to exercise rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data required for successful processing of the order are requested (name and address, contact details). Providing personal data is a necessary requirement for entering into and performing the contract; without providing personal data, it is not possible to conclude the contract or for the Controller to perform it,
sending commercial communications and carrying out other marketing activities.
The Controller carries out automated individual decision-making within the meaning of Article 22 GDPR. You have provided your explicit consent to such processing.


IV. Data Retention Period

The Controller retains personal data:
for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to assert claims arising from these contractual relationships (for a period of 10 years from termination of the contractual relationship).
until consent to the processing of personal data for marketing purposes is withdrawn, for a maximum of 3 years, where personal data are processed on the basis of consent.
After the retention period expires, the Controller will erase the personal data.


V. Recipients of Personal Data (Controller’s Processors/Subcontractors)

Recipients of personal data are persons who:
participate in the delivery of goods/services/the processing of payments under the contract,
provide e-shop operation services and other services related to operation of the e-shop,
provide marketing services,
for the purpose of accounting for tax documents in accordance with the contract and generally binding legal regulations, within the scope of:
- first name and last name, title,
- postal address,
- billing address,
- email address,
- telephone contact,
- bank account details,
- details of the subject matter of the Controller’s performance.
The Controller does not intend to transfer personal data to a third country (a country outside the EU) or an international organisation.


VI. Your Rights

Under the conditions set out in the GDPR, you have:
the right of access to your personal data pursuant to Article 15 GDPR,
the right to rectification of personal data pursuant to Article 16 GDPR, or restriction of processing pursuant to Article 18 GDPR,
the right to erasure of personal data pursuant to Article 17 GDPR,
the right to object to processing pursuant to Article 21 GDPR, and
the right to data portability pursuant to Article 20 GDPR,
the right to withdraw consent to processing in writing or electronically to the Controller’s address or email stated in Article III of these terms.
You also have the right to lodge a complaint with the Úřad pro ochranu osobních údajů (Czech Data Protection Authority) if you believe that your right to personal data protection has been infringed.


VII. Personal Data Security Conditions

The Controller declares that it has adopted all appropriate technical and organisational measures to secure personal data.
The Controller has adopted technical measures to secure data storage (username, password, antivirus program and firewall) and storage of personal data in paper form (locked room).
The Controller declares that only persons authorised by the Controller have access to personal data.


VIII. Final Provisions

By submitting an order via the online order form, you confirm that you have read the personal data protection terms and that you accept them in full.
You agree to these terms by ticking the consent checkbox via the online form. By ticking the consent checkbox, you confirm that you have read the personal data protection terms and that you accept them in full.
The Controller is entitled to change these terms. The new version of the personal data protection terms will be published on the Controller’s website and, at the same time, the Controller will send the new version of these terms to the email address you provided to the Controller.


These terms take effect on 25 May 2018.
